A Trans no les permiten usar el Baño de Mujeres del registro Civil en Guayaquil – Ecuador

Reciba usted un saludo de la Asociación Silueta X, organización de base, creada el 12 de mayo del 2008 según acuerdo ministerial #9989 y cuya misión es la lucha por los Derechos Humanos de las mujeres transgéneros y transexuales, la salud Sexual (prevenir el impacto VIH SIDA afectadas, no afectadas y en posible riesgo de la enfermedad) y el cuidado del Medio Ambiente.

El motivo de la Presente es para dar a conocer que hemos recibido una denuncia de “DISCRIMINACIÓN” en el Registro Civil de Guayaquil, por parte de la ciudadana Transexual femenina Rayzza Rubi Eras Delgado, con numero de cedula 09XXXXXX8, y miembra activa por los Derechos Humanos de la Asociación Silueta X.

En este sentido, nuestra organización ha asesorado a nuestra compañera, para que siga en proceso legal, en la Defensoría del Pueblo y de esta forma hacer prevalecer los Derechos Humanos de las personas diversamente sexuales. Solicito por favor, se le de las facilidades que implican al caso presente, ya que estas personas de esta institución reciban las sanciones que ameriten el caso.

Copio esta documentación para conocimiento de los activistas nacionales, internacionales, instituciones públicas, organizaciones de lucha por los derechos humanos y medios de comunicación para en conjunto estar atentos a las respuestas legales de la defensoría del pueblo de Guayaquil, en pro de los derechos humanos de forma imparcial.

De antemano quedo agradecida por la atención prestada, sin más que comentarle quedo de usted.

Yo, Rayzza Rubi Eras Delgado, transexual femenina con numero de cedula 09XXXXXXX8, me dirigía al Registro Civil en Guayaquil ubicado en las calles 9 de Octubre y Pichincha en compañía de una amiga, también transexual femenina, el día Martes 24 de Julio del 2012 cerca de las 14h00. Al llegar las burlas entre los guardias de seguridad nunca se hacen esperar (siempre es así): “fulanito, te buscan”, “llegaron las hembras de fulanito”, las risas ruidosas entre ellos y el obvio “cuchicheo” por las radios hacia los lugares q nos dirigíamos dentro de las instalaciones hacia nuestro tramite estresante y molesto.

En lo personal, nunca he solicitado ayuda de los guardias de seguridad debido a su mala manera de dirigirse a nosotras las ciudadanas Trans. Pero en su afán de provocar chistes y burlas entre todos los presentes, el guardia de la puerta principal se dirige hacia mi en voz muy alta diciendo: “CABALLEROS POR FAVOR, hagan la fila de ese lado” a lo cual no respondimos, ignorando el comentario, las risas mal disimuladas de sus compañeros y de mas de un ciudadano presente en el lugar, esta actitud estigmatizante ocurre siempre que he llegado a ese lugar por lo que he optado por ignorarlos y actuar con madurez.

Subimos al segundo piso, de forma muy amable nos atendía el personal del Registro Civil y mientras estábamos arriba uno de los guardias nos seguía constantemente hacia donde nos moviéramos mientras le comunicaban algo por el radio, todo ese tiempo nos sentimos en persecución y muy incomodas, no sabíamos porque se nos estaba tratando como si fuéramos delincuentes o en peores casos ser victimas de morbo y comentarios directos fuera de lugar.

Pero lo peor ocurrió antes de abandonar el lugar. Una vez terminado el trámite, antes de salir decidí ir al baño con mi compañera Trans igual que yo. En lo personal nunca uso el inodoro de baños públicos, pero a favor de quienes si lo hacen creo que es muy necesario hacer esta denuncia.

Solo quería lavarme las manos y usar el espejo para retocar mi maquillaje. Mientras estaba en ese plan y conversaba tranquilamente con mi amiga una mujer que limpiaba el baño empezó a hacerle señas a no se quien exactamente, al ver esto mi amiga me comentó: “ Te cuento, que una vez que estuve aquí en este baño vino una guardia de seguridad (mujer) y me saco del baño, diciendo q tenia q usar el baño de hombres. Y mientras me reclamaba, el tipo que limpiaba el baño se dio la libertad de opinar y gritarme que ella tenia razón y que yo no tenia porque utilizar el baño de mujeres”.

Entonces yo, como miembra activa de la Asociación Silueta X, me puse a informarle a qué somos sujetas de derechos según nuestra constitución y que ella como ciudadana ecuatoriana debería saber para no permitir mas abusos en el futuro. A lo que una mujer, cuya edad estaría entre los 40 y 50 años, decidió empezar a opinar. Ella decía que:“si es para usar el espejo y el agua no había problema pero que nosotras no deberíamos entrar a los inodoros. Que es una falta de respeto y por higiene no deberíamos hacerlo porque ahí entran mujeres y eso esta mal. Si vamos a entrar a un baño por necesidades deberíamos ir al baño de hombres… etc etc”. Desatándose en ese momento un debate entre la mencionada y yo. Las cosas se subieron de tono, pero nunca hubo golpes ni groserías mas bien hubieron expresiones como: “entonces, nos bajamos los pantalones para ver q tenemos entre las piernas” dicha por la Sra. de Limpieza.

Decidi seguir con el retoque de mi maquillaje, parando la discusión y no tomar mas en cuenta los comentarios mientras la Sra. De limpieza se iba. Para demostrar que yo tenía tanto derecho como ellas de usar un baño entre a uno de ellos, en un acto simbólico, pues nunca lo utilice. Termine de peinarme y salí.

Al salir del inodoro y regresar al espejo, me disponía a usar perfume cuando aparece un guardia de seguridad en el baño diciendo que una Sra. (la mencionada anteriormente) había hecho una denuncia a ellos y teníamos q salir del baño, que no podíamos estar ahí. Volví a defender mis derechos con este Sr. exigiendo me respeten, pues ellos nunca saben a primera vista si una trans femenina esta o no reasignada sexualmente (operada) y aunque no lo fuera su identidad de género, su apariencia física y en algunos casos su documentación les otorga todo el derecho a utilizar este servicio publico básico en el lugar donde socialmente les corresponde, hasta por seguridad personal.

Le dije que por hechos de discriminación, el podría ser sancionado y talvez hasta separado de su trabajo por abuso, a lo que este funcionario me respondió: «ya pues hagalo»

En ese instante el guardia en cuestión llamo a la guardia de seguridad (mujer) que mencionaba mi amiga. Le preguntó al guardia que le informo el “problema”: “que te dijeron?”. No escuché cual fue su respuesta.

La mujer guardia de seguridad entonces se paro en la puerta del baño y ya para entonces yo estaba cerrando mi bolso para retirarme mientras ella decía “GRACIAS” con señas de abandonar el baño, y nos retiramos no sin antes, al pasar por la puerta principal, encontrarnos con la Sra. quien hizo burla de la situación, esto ante el espectáculo de cientos de personas que están en registro civil, y a vista y paciencia de las mismas autoridades de esta institución que debería garantizar el beneficio social de todos los ciudadanos.

No me parece justo, que hoy en día se den estos tratos en lugares e instituciones públicas. Queriéndonos someter a una situación de riesgo y violencia entrando a baños públicos de hombres siendo visiblemente mujeres, femeninas o simplemente vivir socialmente como parte del género femenino. Más bien creo que moralmente, no se ve nada bien que una transexual femenina entre a un baño de hombres ni por decisión propia u obligación.

En resumen, no me permitieron usar el baño publico femenino del registro civil queriéndoseme obligar a utilizar el baño de hombres por ser transexual. El estrés, vergüenza y el daño emocional, moral y psicológico sufrido durante este acontecimiento lo vivimos todos los días cualquier persona transexual (masculino y femenino) que necesite hacer un tramite en dicha institución del Estado como es el Registro Civil y peor aún, que por mala suerte queramos hacer uso de un baño; todo debido al maltrato de quienes deberían fomentar y garantizar un buen servicio a todas las personas por igual respetando sus derechos y no ser el eje principal de estas denuncias.

En este sentido, puedo reconocer a estos funcionarios quienes son sujetos de un posible acto de estigmatización inicialmente concluyendo en una discriminación.

En el marco jurídico que le compete a la defensoría del pueblo, solicito a través de su gestión la posibilidad de redimir mis derechos y en efecto de las mujeres transexuales que nunca han denunciado estos actos antes mencionados. De esta forma se me está posiblemente estigmatizando y discriminando como mujer transexual que intenta hacer uso de un baño público de mujeres.

Solicito a la defensoría del pueblo intervenir en este caso y de esta forma hacer justicia ante mis derechos que se encuentran posiblemente violentados, para de esta forma las acciones que se tomen contra estos individuos e individuas antes mencionados puedan en algo reparar el daño mora, emocional y psicológico que me han causado.

A Trans not allowed to use the ladies room of the Civil Registry in Guayaquil – Ecuador

Get you a greeting Silueta X Association, a grassroots organization, created on May 12, 2008 by Ministerial Order # 9989 and whose mission is to fight for human rights of transgender and transsexual women, sexual health (preventing the impact HIV AIDS affected, unaffected and potential risk of disease) and environmental care.

The reason for the Present is to make known that we have received a complaint of «discrimination» in the Registry Office of Guayaquil, by the female citizen Rayzza Transsexual Ruby Eras Delgado, 09XXXXXX8 identity card number, and active member for the Rights Human Silueta X Association.

In this sense, our organization has assisted our partner, to keep it in a legal trial, the Ombudsman and thus to assert the human rights of people variously sex. I request please be given facilities involving the present case, since these people in this institution receive the punishment they merit the case.

I copy this documentation to knowledge of national activists, international institutions, organizations fighting for human rights and media together to be aware of the legal responses of the ombudsman of Guayaquil, on behalf of human rights impartially.

I, Rubi Rayzza Eras Delgado, transsexual female with 09XXXXXXX8 identity card number, I went to the registry office in Guayaquil is located on the streets on October 9 and Pichincha in the company of a friend, also female transsexual, on Tuesday July 24, 2012 near 14:00. Arriving teasing between the security guards are never expect (always) «so and so, I seek,» «so and so came the female» loud laughter between them and the obvious «buzz» on the radio to the q places we were going inside the facility processed into our stressful and annoying.

Personally, I never asked for help from security guards because of their bad way to contact us, the citizens Trans. But in their desire to provoke jokes and ridicule among all present, the main gate guard goes to my very loudly saying: «GENTLEMEN PLEASE make the row on that side» to which we did not respond, ignoring the comment, the ill-concealed laughter of his companions and more than one citizen at the scene, stigmatizing attitude occurs whenever I got there so I’ve chosen to ignore them and act maturely.

We climbed to the second floor, very friendly staff looked after us from the Civil Registry and while we were up one of the guards followed us to where we moved constantly as he communicated something of the radio, all the while we are in pursuit and very uncomfortable, did not know because we were treated like we were criminals or in worst cases being victims of curiosity and comment directly out of place.

But the worst happened before leaving the site. After the procedure, before leaving I decided to go to the bathroom with my partner as I Trans. I personally never use the toilet in public bathrooms, but for those who do think it is very necessary to make this complaint.

I just wanted to wash my hands and use the mirror to touch up my makeup. While in the plan and talking quietly with my friend, a woman who cleaned the bathroom began to beckon to not know who exactly, seeing that my friend told me, «I tell you, that once was here in this room came a security guard (female) and I take my bath, I was saying q q use the men’s room. And as I claimed, the guy who cleaned the bathroom was free to say and shout that she was right and because I had not used the ladies room. «

Then I, as an active member of the Silueta X Association, began to tell me why we are subject to rights under our constitution and that she as an Ecuadorian should know not to allow more abuses in the future. To which a woman whose age would be between 40 and 50, decided to start a review. She said that «if it is to use the mirror and the water was no problem but we should not go to the toilets. That is disrespectful and hygiene should not do it because that women come and that is wrong. If we are to enter a bath needs should go to the men’s room … etc etc «. Then unleashing a debate between the aforementioned and me. Things escalated, but there was never rude shock or rather there were phrases like, «So, we got the pants for q we see between the legs» spoken by Mrs. Clean.

I decided to stick with my makeup touch-up, stopping the discussion and not take more into account the comments while Mrs. De was cleaning. To prove that I had as much right as them to use a bathroom between one of them, in a symbolic act, he never uses it. Finish my hair and left.

Leaving the toilet and return to the mirror, I was about to wear perfume when a security guard in the bathroom saying that a Mrs. (mentioned above) had made a complaint to them and we had q out of the bathroom, we could not be there. I went back to defend my rights with this Mr demanding respect me because they never know at a glance if a trans woman is sexually reassigned or not (op) and although it was not their gender identity, physical appearance and in some cases their documentation gives them every right to use this basic public service where socially they should, even for personal safety.

I told him for acts of discrimination, could be punished and maybe even separate his work from abuse, to which the officer replied: «and then do it»

Just then the guard in question call the security guard (female) I mentioned my friend. He asked the guard who reported the «problem»: «they told you?». I did not hear what was your answer.

The woman security guard then stood on the bathroom door and by then I was closing my bag to retire while she said «Thanks» with signs of leaving the bathroom, and we retired but not before passing through the front door , meet with Mrs. who made fun of the situation, that at the sight of hundreds of people in civil registration, and full view of the same authorities of this institution should ensure that the social benefit of all citizens.

Does not seem fair, today is give these deals in places and public institutions. Loving each subject a risk and going into public restrooms violence of men being visibly women, female or just living socially as part of the female gender. Rather I think morally, can not see anything good that a transsexual woman enters a men’s room or by choice or obligation.

In short, do not let me use the public toilet female civil registry queriéndoseme necessary to use the men’s room for being transsexual. Stress, embarrassment and emotional distress, moral and psychological suffering during this event we experience every day any transgender person (male and female) need to make a submission on the institution of the State as the Civil Registry and worse, by bad luck we want to use a bathroom, all due to abuse of those who should promote and ensure good service to all people equally respecting their rights and not the main focus of these complaints.

In this sense, I can recognize those officers who are subjects of a possible act of stigmatization initially concluding in discrimination.

In the legal framework it is up to the ombudsman, I request through his management the chance to redeem my rights and indeed transsexual women who have never denounced these acts mentioned above. This is possibly I stigmatizing and discriminating as a transsexual woman who tries to use a public restroom for women.

I ask the ombudsman to intervene in this case and thus do justice to my rights that are possibly violated, and in this way the actions taken against these individuals and individuas above can repair the damage somewhat overdue, emotional and psychological that I have caused.
