RECHAZO A DECLARACIONES DE ZAVALA POR PARTE DE DIANE RODRÍGUEZ

Con indignación, arcada y estupor, rechazo categóricamente las expresiones vertidas por el Ex Candidato Presidencial Pastor Nelson Zavala hacia mi persona, del cual cito textualmente del programa “Contacto Directo”, en su horario matutino de 7 a 8 de la mañana, del 14 de Marzo del año 2013:

“Tenemos a este señor que se disfraza de mujer y que se hace llamar creo que Diane, cuando realmente es un hombre”.

En efecto, no voy a negar mi realidad cromosómica XY, sin embargo, eso es algo que le  compete únicamente a mí persona y que en este caso, se la ha irrespetado según el Art. 83 Num. 14 de la Constitución de la República del Ecuador.

El que yo lo haya hecho público anteriormente, no es una autorización implícita, pues resulta una arbitrariedad según el Art. 66 Num. 11 de la Carta Magna. Mi revelación se debe a la muestra de la realidad de los grupos GLBTI, a través de mi activismo político. Por tanto, estas expresiones, exponen frívolamente mi intimidad sexual y mancillan mi Identidad de Género, reconocida como un Derecho Fundamental en el Art. 11 Num. 2 del mismo cuerpo legal.

Justamente por estas cuestiones, varios colectivos (Proyecto Transgénero, Asociación Silueta X, Confetrans, etc.) hemos presentado las Reformas a La Ley del Registro Civil, en materia de Identidad de Género, a través de la campaña “Mi Genero en Mi Cedula”, para que el candado biologicísta desaparezca de un documento público, como es la cédula de identidad.

La forma despectiva, veleidosa y enajenada con la se refiere a las poblaciones sexo – genéricamente diferentes, no pueden ser objeto de maculación, por lo que las autoridades competentes deberían tomar cartas en el asunto.  

Todxs, las y los ecuatorianos/as pueden expresar su pensamiento y su Fe en la medida que no incite, estigmatice o discrimine a ningún ciudadano con esas palabras. Podemos exponer y evidenciar nuestras ideologías, pero las palabras o actos discriminatorios no están bajo el paraguas de la libertad de expresión. Por tanto, resulta contraproducente en un Estado Laico como Ecuador, donde priman los derechos humanos, ante cualquier vulneración, independientemente desde que doctrina provengan.

No descarto y me reservo la posibilidad de iniciar un proceso legal en contra del Señor Nelson Zavala, debido a que sus declaraciones, me han discriminado directamente y no solo a mi, si no a mi entorno, amigos y familiares, quienes han visto como he sido utilizada para construir un discurso Homo/Les/Transfóbico y discriminatorio y que solo pretende privarnos de nuestros derechos constitucionalmente establecidos.

ZAVALA REJECTION STATEMENTS BY DIANE RODRIGUEZ

With indignation, arcade and stupor, I categorically reject the statements made by the former presidential candidate Pastor Nelson Zavala towards me, which I quote the program «Direct Contact» in its earlier morning from 7 to 8 am, 14 March 2013:

«We have this man who dresses as a woman and calling himself think Diane, when really it’s a man.»

Indeed, I will not deny my reality XY chromosome, however, that is something that will matter just for me and that in this case, it has been disrespected by No. 14 Article 83 of the Constitution of the Republic of Ecuador.

Which I have previously made public, there is an implicit authorization, because it is an arbitrariness under Article 66 No. 11 of the Constitution. My revelation is due to the reality shows of GLBTI groups, through my political activism. Therefore these expressions, frivolously exposed sexual intimacy and sully my my gender identity, recognized as a fundamental right in Article 11 No. 2 of the same Act.

Precisely for these issues, several groups (Transgender Project, Silueta X Association, Confetrans, etc.) Have presented the amendments to the Civil Registration Act, on Gender Identity, through the campaign «My gender on my identity card» , biologist for padlock disappears from public documents, such as identity card.

The derogatory way, fickle and alienated with regards sex populations – generically different, are not subject to tainting, so that the competent authorities should take action on the matter.

Everybody, the Ecuadorians and / as can express their thoughts and their faith insofar as not incite, stigmatize or discriminate against any citizen with those words. We explain and demonstrate our ideologies, but the words or acts of discrimination are not under the umbrella of freedom of expression. Therefore, it is counterproductive in a secular state like Ecuador, where human rights prevail, against any breach, regardless from which doctrine come.

Not rule and I reserve the possibility of initiating legal proceedings against the Lord Nelson Zavala, because their statements, have discriminated me directly and not only to me, if not my environment, friends and family who I have seen been used to construct a speech Homo / Les / transphobic and discriminatory and that only seeks to deprive us of our rights constitutionally established.
