Rodríguez demanda a juez ante la Corte.

Insiste en cambio de sexo en su cédula

El comité permanente  de Derechos Humanos CEPDHU y la Asociación Silueta X denunciaron ayer en Guayaquil que el juez primero de lo Civil del Guayas, Ricardo Rivadeneira, negó el recurso de protección que en 2009 interpuso Diane Rodríguez contra la Dirección General del Registro Civil.

La demanda fue presentada por Rodríguez, actual presidenta de la Asociación Silueta X y representante del observatorio GLBTI, por cuanto el entonces director del Registro Civil, Paulo Rodíguez,  no permitió el cambio de su sexo, de masculino a femenino, en su cédula de identidad.

La decisión de Rivadeneira fue ratificada en 2011 por la Tercera Sala de lo Penal del Guayas.

Diane Rodríguez reiteró que la decisión de Paulo Rodríguez no está motivada en base a lo que dispone la Constitución. Por tal razón y en base a lo que dispone el artículo 92 de la Constitución  anunció la presentación de una acción de protección extraordinaria de segunda instancia para llevar al juez Rivadeneira hasta la Corte Constitucional.

Si el Consejo de la Judicatura del Guayas niega su pedido, acudirá a la Corte Interamericana de Derechos Humanos.

Rodríguez dijo que  busca  marcar un precedente para que la población trans pueda identificarse de forma legal. Reiteró que estas dificultades molestan a la población transexual porque cada vez  debe dar explicaciones de situaciones que corresponden a la parte privada de las personas.

La activista Rodríguez ponderó el apoyo de los representantes del CEPDHU de Guayaquil en su empeño porque se reconozcan sus derechos y su identidad de sexo. (AM)

The Standing Committee on Human Rights and the Association CEPDHU Silueta X Guayaquil reported yesterday in the first of the Civil Judge of Guayas, Ricardo Rivadeneira, denied the application for protection in 2009 Diane Rodriguez filed against the Department of Vital Records.

The lawsuit was filed by Rodriguez, current president of the Association Representative Silueta X GLBTI observatory, because the then Director of the Civil Registry, Paulo Rodíguez, did not allow the change of sex, from male to female, in his identity card .

Rivadeneira’s decision was upheld in 2011 by the Third Criminal Chamber of Guayas.

Diane Rodriguez reiterated that the decision is not motivated Paulo Rodriguez based on what the Constitution provides. For this reason and based on what is stated in Article 92 of the Constitution announced the presentation of extraordinary protective action of second instance to bring the judge to the Constitutional Court Rivadeneira.

Rodriguez said it wants to set a precedent for trans people can identify legally. He reiterated that these difficulties transgender people bother because every time must account for situations that correspond to the privacy of individuals.
