Transexual viaja a USA para presentar queja legal ante la CIDH

La Activista, representante GLBTI ante el Comité Ecuatoriano Permanente de Derechos Humanos y Directora de la Asociación Silueta X, Diane Rodríguez, viajó el sábado 25 de enero del 2014 a Washington DC. con la finalidad de desarrollar una agenda de trabajo con varias organizaciones en Estados Unidos, a través del programa de “Liderazgo Internacional” del Department of State.

Entre su variada agenda, se encuentra la presentación de la Queja legal del cambio de Sexo masculino a femenino en su documento de identidad, ante la Comisión Interamericana de Derechos Humanos, quien fuese negada en el año 2011 por el Juez primero de lo civil del Guayas, argumentándose con la Biblia. La queja legal gira entorno a los siguientes aspectos:

1.- Utilización de la Biblia para una sentencia, en un país Laico, según artículo 1 de la Constitución de la República del Ecuador.

2.- La Vulneración de la Identidad de Género, El libre desarrollo de la Personalidad, La intimidad e integridad sexual, según articulo 66 numerales, 3,5 y 20 del mismo cuerpo legal.

3.- El desconocimiento de la afectada (verbal y físico) ante la ratificación de la sentencia por la 3era Sala de lo Penal del Guayas, la cual nunca se le comunicó, ni a través de la Sala o la Defensoría del Pueblo.

4.- La consideración de Precedente Legal del caso de Estrella Estévez del año 2009, al sentenciarse en 2da instancia la 3era sala de lo penal en Pichincha su sexo femenino, sin haberse sometido a una cirugía de reasignación sexual.

5.- El reparo del daño moral, psicológico e integridad personal, causado por el Registro Civil, los Juzgados y los actores que se hayan visto implicados ante el estigma, discriminación y violación de sus derechos humanos.

La queja legal será presentada oficialmente el Miércoles 29 de Enero a las 15:30 en la Comisión Interamericana de Derechos Humanos 1889 F Street NW Washington, D.C., 20006, USA.

Transexual travels to USA to present legal complaint with the IACHR

The Activist, GLBTI Ecuadorian representative to the Standing Committee on Human Rights and Director of the Silueta X Association , Diane Rodriguez, traveled on Saturday January 25, 2014 in Washington DC . in order to develop an agenda with several organizations in the United States , through the program » International Leadership » of the Department of State .

Among his varied agenda is the presentation Legal Complaint change Masculine to feminine in their identity , before the Commission on Human Rights, whoever it was denied in 2011 by the first Judge of civil Guayas , arguing with the Bible. The legal complaint revolves around the following:

. 1 – Using the Bible to a judgment in a secular country, according to Article 1 of the Constitution of the Republic of Ecuador .

. 2 – The Violation of Gender Identity , The free development of personality , Intimacy and sexual integrity , according to article 66 paragraphs , 3.5 and 20 of the same Code .

. 3 – Ignorance of the affected (verbal and physical) to the ratification of the judgment by the 3rd Criminal Division of Guayas, which was never reported , nor by the Board or the Ombudsman .

. 4 – Consideration of Previous Legal Case Estrella Estevez 2009, to be sentenced for 2nd 3rd instance criminal division in Pichincha her sex, without having undergone sex reassignment surgery .

. 5 – The repair of moral , psychological and physical integrity damage caused by the Registry , the Courts and the actors who have been involved with the stigma, discrimination and violation of their human rights.

The legal complaint will be officially launched on Wednesday January 29th at 15:30 in the Inter-American Commission on Human Rights 1889 F Street NW Washington, DC 20006 , USA .
