DEFENSORIA DEL PUEBLO DEL ECUADOR.- COORDINACIÓN GENERAL DEFENSORIAL ZONAL 8.- Guayaquil, Enero 21 del 2014; las 15:20.-

REFERENCIAL:

En virtud de la queja presentada por la señorita DIANE RODRIGUEZ, ACTIVISTA GLB TRANS, en su calidad de PRESIDENTA ASOCIACIÓN SILUETA X, OBSERVATORIO GLBTI DE ECUADOR, quien nos pone en conocimiento del presunto trato discriminatorio del que fuera objeto el ciudadano JEFFERSON JIMENEZ SILVA por parte del personal de seguridad del CENTRO COMERCIAL MALL DEL SOL,  a quien al parecer no le permitieron el ingreso por su vestimenta, calificado de emo y pandillero. Por las consideraciones expuesta solicita la intervención de la defensoria del Pueblo.

OBJETO: 

En virtud de la obligación que tiene la Defensoria del Pueblo en defender y excitar de oficio, o a petición de parte, la observación de los derechos fundamentales, individuales y colectivos que la constitución de la República, las leyes, los convenios y tratados internacionales ratificados por el Ecuador garanticen.

En conformidad con lo que estipula el articulo 215 de la constitución de las República, en concordancia con los artículos 2, literal b); 8, literal g); y 13 de la Ley Orgánica de la Defensoria del Pueblo, INICIO el presente EXPEDIENTE DEFENSORIAL por presuntas afectaciones a garantías y derechos constitucionales, tales como el derecho a la igualdad, a la no discriminación, y demás que se evidencien en esta investigación.

En mi calidad de Coordinadora General Defensorial Zonal 8, dispongo lo siguiente:

DISPOSICIONES:

1.- Se notifique con esta providencia a los representantes del CENTRO COMERCIAL MALL DEL SOL,  para que contesten los fundamentos de la queja, la cual se anexa en copia junto con esta providencia.

2.- Sin perjuicio de aquello, se solicita al ciudadano JEFFERSON JIMENEZ SILVA, se sirva indicarnos la relación de los hechos suscitados e identificación clara de los presuntos autores del hecho que se denuncia, esto con el propósito que nos sirvan de elementos para viabilizar el tramite y arribar al esclarecimiento de los hechos. Para lo cual podrá presentarse en esta oficina, en el plazo de ocho días para que rinda su testimonio. A quien se le notificara a través de la ASOCIACIÓN SILUETA X, OBSERVATORIO GLBTI DE ECUADOR,  por ser quienes pones en nuestro conocimiento la presente queja.

3.-Se delega a la Ab. Lourdes Rangel Donoso, para los fines pertinentes.

4.- Notifiquese en los domicilios señalados.

REFERENCE :

Under the complaint filed by Ms. DIANE RODRIGUEZ, ACTIVIST TRANS GLB , as of SILUETA X ASSOCIATION PRESIDENT, GLBTI OBSERVATORY OF ECUADOR, who makes us aware of the alleged discriminatory treatment which was the subject of a citizen by JEFFERSON JIMENEZ SILVA security staff mALL mALL DEL SOL, who apparently did not allow him to enter his clothing, emo and gangster qualified. By the considerations exposed requested the intervention of the Ombudsman.

OBJECT :

Under the obligation on the Ombudsman to defend and ex officio or upon request , observation of fundamental individual and collective rights that the constitution of the Republic , laws, international conventions and treaties ratified by the Ecuador guarantee .

In accordance with the stipulations of Article 215 of the Constitution of the Republic , in accordance with Articles 2, letter b ), 8 , literal g ) and 13 of the Organic Law on the Ombudsman , Ombudsman HOME RECORD this for alleged damages to constitutional guarantees and rights such as the right to equality, non-discrimination, and others that are evident in this research.

In my capacity as Coordinator General Defensorial Zonal 8 , I have the following:

PROVISIONS :

1 – . Were notified this providence representatives MALL MALL DEL SOL, to answer the substance of the complaint , which is attached in copy with this ruling .

2 – . Notwithstanding this, the citizen JEFFERSON JIMENEZ SILVA requested to kindly indicate the relationship of the raised facts and clear identification of alleged perpetrators that complaint, this in order to serve us with elements to make possible the processed and arrive to clarify the facts . To which may be submitted in this office within eight days to his or her testimony . Who will be notified through the ASSOCIATION SILHOUETTE X , GLBTI OBSERVATORY OF ECUADOR , for who put our knowledge in this complaint.
