Presentan primera queja GLBTI de Ecuador ante CIDH.

La activista Diane Rodriguez presento una queja ante la Comisión Interamericana de Derechos Humanos (CIDH), en Washington, Estados Unidos. El asunto del tramite es la queja legal sobre el cambio de sexo en el documento de identidad, presentada el 15 de Octubre del 2009, mismo que fue negado el 5 de julio del 2010, por el Juez Ricardo Rivadeneira en el Juzgado 1ero de lo civil.

El 21 de noviembre del 2011, la tercera sala de lo penal, colusorios y transito del Guayas tramita la causa 09123-2010-0681, cuya causa anterior es del Juez 1ero civil – (2010-01-20) – No.: 09301-2010-0053, la cual ratifica la sentencia y se remitió a la corte constitucional.

Sin embargo, según se informa, la representante de Silueta X, nunca recibió notificación sobre la ratificación en segunda instancia, ni a través de la Defensoria del pueblo, o de la 3era sala de lo penal del Guayas, prescribiendo de esta forma el proceso.

La afectada manifiesta, a través de la queja legal presentada ante la comisión Interamericana de Derechos Humanos, que se percata de la ratificación de la sentencia en octubre del 2013, gracias a un estudio que estaba realizando la Asociación Silueta X.

De esta forma, inicia nuevamente el tramite para continuar su caso. Inclusive, presento dos comunicados que se enviaron consultando sobre su caso el 28 de noviembre del 2011- siete días después de la ultima sentencia – y el 13 de abril del 2011. En ningún caso recibió respuesta o notificación física.

Con estos antecedentes por omisión o bloqueo al derecho por identidad de genero se presento la queja legal ante el Funcionario Lucas Mendos de la CIDH, que al momento se entendería es la primera de su tipo, ante la reivindicación de los Derechos LGBTI y específicamente en identidad de genero por Ecuador. La queja, en conjunto con los documentos, entrara a revisión en los siguientes mese.

La activista manifestó que la queja legal dejo de ser personal, y que ahora es una lucha colectiva. A este caso se suman cuatro mas, de personas transexuales que solicitan el cambio de sexo presentada el 28 de noviembre del 2011, tres transexuales femeninas y uno masculino. Así mismo otro caso de un trans masculino Ecuatoriano que reside en Chile, y que al igual que Diane, inicio las gestiones para presentar la queja legal.

El caso de ser favorable, podría crear como precedente el reconocimiento del sexo en el documento de identidad de las personas trans en el Ecuador, sin tener que pasar por una cirugía de reasignacion sexual (requisito obligatorio para reconocer el sexo femenino actualmente) ni por un juzgado, de la fecha en adelante que se emita las recomendaciones o sentencia, dependiendo del caso.
