Programas de humor podrían ser sancionados por supuesta discriminación.
La Ley Orgánica de Comunicación dispone en su art. 55 la conformación de dos instituciones de carácter público: la Superintendencia de Comunicación y el Consejo de Regulación y Desarrollo de la Comunicación.
De estas instituciones, que conforman el Sistema de Comunicación Social en el país, la Superintendencia de la Información y Comunicación –SUPERCOM– es un organismo técnico de vigilancia que debe resolver las denuncias que realizan las personas en materia de derechos de comunicación; aplicar sanciones en el marco de la Ley vigente.
En los seis primeros meses de creación, la SUPERCOM recibió 92 denuncias por parte de ciudadanos y varias agrupaciones de las cuales se han impuesto 7 sanciones a medios privados como Extra y Ecuavisa.
En el marco de estas denuncias, existe una que de concretarse podría sancionar a varias series de TV. Recientemente la organización Silueta X –colectivo en defensa de los derechos GLBTI– informó que presentará una queja ante la SUPERCOM para que series como la Pareja Feliz, Mi Recinto, Los compadritos o Así pasa, “exploten su creatividad con responsabilidad social”, como lo indica la presidenta de este gremio Diane Rodríguez.
En un comunicado difundido vía correo electrónico la agrupación considera que “estos programas contribuyen a la estandarización de los estereotipos de discriminación contra las poblaciones históricamente discriminadas como lo son: Indígenas, Afroecuatorianos, Montubios, GLBTI, la Mujer”.
Pero, en estos últimos días ha circulado una declaración más radical en torno a estos programas. Ramiro Rivadeneira, el recién electo Defensor del Pueblo, quien dijo hará “todos los esfuerzos posibles” para que se eliminen para siempre estos espacios que a su criterio, denigran al ser humano.

“ESPERO ACCIONES INNOVADORAS PARA UN HUMOR SANO”
Exactamente, ¿cuál es su propósito con esta denuncia? ¿Que salgan del aire estos programas definitivamente o que su forma de hacer humor cambie?
Desde el año 2013 la sociedad civil ha intentado un dialogo con los humoristas. Me refiero a GLBTI, Mujeres, indigenas, afros, etc. Sin embargo ellos han hecho caso omiso. En este año a inicio la Asociación Silueta X a través de su campaña http://www.tiempodeigualdad.comlanzo mensaje a los comediantes como por ejemplo: “Hazme reír inteligentemente”. Buscamos que los comediantes exploten su creatividad pero con responsabilidad social, sin discriminar a nadie. Es un reto para ellos y deben tomarlo así, una apuesta a mejorar la calidad de vida a través de un sonrisa que no este detrás el estigma y discriminación.
Ud. envío algún comunicado con anterioridad a los realizadores de estos programas para que cambien su forma de hacer humor o quiere plantear en primera instancia la queja, si es así, ¿por qué?
Específicamente Silueta X no, pero hay varios activistas que han enviado comunicados a los realizadores de Vivos por ejemplo. Ellos hicieron caso Omiso. Silueta X lo que hizo fue lanzar la campaña a inicios de este año. Lo que realmente molesta es que ellos contestan a todos sus fans a través de las redes sociales, pero a nosotros no nos
prestaron atención. Ni siquiera por cortesía.
¿Cuál sería para ud. la mejor forma de hacer humor inteligente?
Esa es la tarea del cómico. La mía es velar por la responsabilidad social, las leyes y que se cumplan.
¿Qué piensa de las personas que integran los grupos vulnerados y que quizás les resulta indiferente y hasta en ciertos casos se identifican con los personajes que aparecen en estos programas?
Responden a este sistema donde lamentablemente no han percibido el daño que les hace. El hecho que unos esten a favor o en contra no significa que la queja este mal planteada. Tampoco es un concurso de popularidad… simplemente es respeto a la constitución y a la actual ley de comunicación.
En el caso de que la queja se concrete, ¿cuál cree ud. que será la reacción de los realizadores de estos programas? ¿Qué implica enfrentar a la producción de un medio de comunicación?
Yo espero que ellos muestren ideas y acciones innovadoras para un humor sano, eso espero de ellos. No nos han prestado atención con un dialogo sin intervención de autoridades de derechos, entonces que intervengan ellos para que se concreten las buenas acciones.
Bueno, no voy a negar que es un monstruo social. Pero en todo caso para estoy y estamos lo activadores y agitadores sociales… hacer entender que es cuestión de responsabilidad social.

“SI NOS TOCA HACER CORRECTIVOS LO HAREMOS”
El art. 61 de la Ley de Comunicación prohíbe el contenido discriminatorio por razones como la identidad cultural o la orientación sexual. ¿Cómo se están manejando los contenidos del programas VIVOS desde que entró en vigencia la Ley?
Desde antes que entre en vigencia la ley nosotros cuidamos mucho aquello de la exclusión o la apología de la discriminación
La Asociación Silueta X indica que varios ciudadanos y otras agrupaciones le han enviado varios comunicados al programa VIVOS para que empiecen a ser -lo que consideran ellos – programas con humor inteligente sin discriminar a las minorías, pero la presidenta de Silueta X, Diane Rodríguez indica que ustedes solo se han limitado a responder a sus fans a través de las redes sociales, pero no directamente a quienes hicieron las solicitudes. ¿Cómo respondería a eso?
Un tweet no es un comunicado oficial …nosotros recibimos tweets de felicitaciones ,criticas, sugerencias pero creo que un comunicado no entra en 140 caracteres, así que todo lo enviado por el señor Rodríguez es considerado una critica mas…… tampoco sabia que el era presidente de la asociación Silueta X
3) Durante este caso, son recurrente las palabras: humor inteligente. ¿Cómo se hace humor inteligente? ¿Ud. cree que el programa vivos hace humor inteligente? ¿por qué?
Te juro que me he tomado la molestia de investigar que es humor inteligente y lo poco que he encontrado en internet como definición ha sido: humor que invita a pensar , también juego de palabras y un humor que pocos lo entiendan….y hemos utilizado en VIVOS y PAREJA FELIZ igual que el humor negro también el doble sentido y hasta triple sentido jeje …
Yo creo que agarra la palabra “inteligente” para demostrar que es intelectual .
¿Cuál cree que será el futuro de este proceso? ¿Cree que la demanda por parte de Silueta X y otros colectivos se concretará ante la SUPERCOM? y de ser así, ¿cómo responderán ustedes?
Desconozco que hayan hecho una demanda…tienen todo su derecho de hacerlo y nosotros de responder
Recientemente su colega Flor María Palomeque ha publicado varias fotografías en Instagram donde se ve a su personaje de la Mofle junto al Presidente Correa, ¿Ud. cree que este aparente vínculo o relación podría beneficiar de cierta manera que la demanda no se concrete?
Fue una respuesta extremista a un comentario extremista de un servidor Público como el defensor del pueblo Dr. Ramiro Rivadeneira.
Si bien es cierto en programas como VIVOS se hace una variedad de parodias, desde políticos hasta presentadores de TV, pero también son recurrentes las parodias a personas de una minoría sexual y étnica. ¿Alguna vez ellos le ha dicho por la calle que se siente ofendido o no identificado con el programa?
En algunos casos las personas que he parodiado sí, pero de manera cordial y han sido pocas pero de personas de minoría sexual y étnica Jamás
En las redes se ven frases como: “si no te gusta cambia de canal” haciendo alusión a la posible demanda. ¿Por qué cree que la gente dice esto? ¿Qué piensa de esta frase?
Porque se habla de un programa de TV donde el televidente tiene la libertad de cambiar de canal si no les gusta. PAREJA FELIZ es un programa que goza de mucha sintonía y seria injusto que a la mayoría de televidentes que disfrutan del programa se lo quiten del aire por eso reaccionan así con esa frase…además tenemos derecho a la LIBERTAD de elegir.
Para concluir, no somos homofóbicos ni racistas ni machistas incluso en mi equipo creativo y de producción tememos compañeros gays a los que le he preguntado con mucha preocupación debido a los tweets que he recibido si realmente se sienten ofendidos con nuestro trabajo y ellos me han respondido de manera sincera que no.
Sabemos que tenemos un compromiso social al tener un programa al aire pero también nos basamos en que la televisión es un medio de entretenimiento…. Pareja feliz es una exageración de lo que no se debe hacer en el matrimonio….el representar a un indígena (MOTI) o a una negra (PECHICHE) no significa que se esta denigrando a una raza es una representación o caracterización nada mas
Y si nos toca hacer correctivos lo haremos.
OPINIÓN
Los programas de humor en la televisión recogen los imaginarios sociales, las situaciones que se viven en las calles, en los hogares o en los centros de estudios para ser redirigidos en forma de personajes y situaciones relativamente graciosas.
Estos espacios resultan para algunas personas ofensivos porque al ser programas cómicos se exageran ciertas conductas, rasgos y algunas expresiones, con las cuales no todos se identifican, y segundo porque son espacios que al transmitirse en señal abierta se esparcen como pólvora dentro de una sociedad intolerante y con poca educación como la nuestra.
Los programas de humor del Ecuador no tendrían éxito si representaran situaciones de otras partes del mundo, de otros contextos y está ahí la respuesta para entender por qué ciertos espacios refuerzan –intencionalmente o no- una discriminación que en el país siempre ha existido. Hay que dejar de ver a la televisión como la única culpable de los problemas segregacionistas porque ésta es parte de lo que refleja nuestra sociedad.
Hay que considerar que una posible concreción de la queja por parte de Silueta X ante la SUPERCOM tampoco garantizará –al menos por ahora- el fin de la discriminación. Lograr esto resulta titánico sobre todo cuando se difunde material audiovisual en Internet con un contenido igual o quizás más discriminatorio que muchas de las parodias y caricaturizaciones de algunos programas que se emiten por los medios.
Si queremos acabar con la discriminación a grupos vulnerables y fomentar una buena calidad de programación en los medios es importante, a más de cuestionar la calidad de estos espacio, inculcar el respeto y la tolerancia desde la familia, aprovechar el marco de la actual reforma educativa para plantear la inclusión de materias tales como derechos humanos y convivir ciudadano desde la primaria, a fin de cambios más estructurales.

The Communications Law provides in art . 55 the formation of two public institutions : the Superintendency of Communication and the Council for the Regulation and Development of Communication .

In a statement released via email the group believes that » these programs contribute to the standardization of stereotypes discrimination against historically discriminated populations such as: Indigenous , Afro-Ecuadorian , Montubios , GLBTI , Women».
But in these last days he has circulated a radical statement about these programs. Ramiro Rivadeneira , newly elected Ombudsman , who he said make » every effort » to be deleted forever these spaces at its discretion, denigrates the human person.

Exactly what is your purpose with this report? What these programs out of the air or definitely your way to change mood ?
Since 2013, civil society has sought a dialogue with the comedians . I mean GLBTI , Women, Indians, afros, etc. . However, they have ignored . This year to start the Silueta X Association through its campaign message http://www.tiempodeigualdad.comlanzo comedians such as: «Make me laugh intelligently.» We seek to exploit their creativity comedians but with social responsibility, without discriminating against anyone. It is a challenge for them and should thus take a bet on improving the quality of life through a smile that is not behind the stigma and discrimination.
Send you a statement prior to the makers of these programs to change their way of doing mood or want to raise the complaint in the first instance, and if so, why ?
Specifically Silueta X no, but several activists who have sent press releases to the makers of Living by example . They did Disregard case. Silueta X what I did was launch the campaign earlier this year. What really bothers is that they answer all your fans through social networks, but we did not we paid attention. Not even a courtesy.
What would be for you. the best way to make intelligent humor ?
That is the task of the comic . Mine is to ensure social responsibility, and laws are met.
What do you think of the people within the groups violated and perhaps are indifferent and even in some cases are identified with the characters in these programs?
Respond to this system which unfortunately have not noticed the damage it does to them. The fact that some are in favor or against the complaint does not mean that this ill-conceived. Nor is it a popularity contest … it’s simply respect for the constitution and the current media law .
In the event that the complaint is concrete , what do ud . that the reaction of the makers of these programs? What does face producing a media ?
I hope they show innovative ideas and actions for a healthy humor, I hope them. We have not paid attention to a dialogue without the intervention of authorities Free, then involving them to good actions are realized .
Well, I will not deny that it is a social monster. But at least for what I am and I are activators and social agitators … do understand that it is a matter of social responsibility.

I swear I ‘ve bothered to investigate who is intelligent humor and what little I’ve found on the internet as definition is : humor that invites us to think , also pun and humor that few understand …. and we have used HAPPY COUPLE LIVING and black humor as well the double meaning and even triple sense lol …
I think grasping the word » smart» to show it is intellectual .
What do you think will be the future of this process? Do you think the demand from Silueta X and other groups will be implemented before the SUPERCOM ? and if so , how do you respond ?
Not know they have made a complaint … they have every right to do so and we respond
Recently a colleague Flor María Palomeque has published several photos on Instagram where you see your character in the Muffler with President Correa , do you believes that this apparent link or relationship could benefit in some way that does not demand concrete ?
It was an extreme response to an extreme statement of a public server as ombudsman Ramiro Dr. Rivadeneira .
While programs like LIVE parodies a variety of blocks , from politicians to TV presenters , but also recurring parodies people from sexual and ethnic minorities. Have you ever been told them by the street that is offended or not identified with the program?
In some cases people I’ve parodied yes, but cordially and have been but few people in sexual minority and ethnic Never.
In networks are phrases like : «If you do not like change channels » hinting at the possible demand . Why do people say this? What do you think of this sentence ?
Because talking about a TV show where the viewer is free to change the channel if they do not like . HAPPY COUPLE is a program that has a lot of tuning and it would be unfair to the majority of viewers who enjoy the program will remove it from the air that react well with that phrase … we also have the right to FREEDOM of choice.
In conclusion , we are not homophobic or racist or sexist even in my creative and production team we fear fellow gays to which I have asked with great concern because of the tweets I’ve received if you really feel offended with our work and they have answered me not so sincere .
We know we have a social commitment to have a program to air but we also rely on that television is a medium of entertainment …. Happy couple is an exaggeration of what not to do in marriage …. depicting an Indian ( MOTI ) or a black ( Pechiche ) this does not mean that one race is denigrating representation or nothing more characterization
And if we have to we will make corrections.
OPINION
Comedy programs on television reflected the social imaginary situations that live on the streets , in homes or in centers of studies to be redirected as relatively characters and funny situations .
These spaces are offensive to some people because as comedy shows certain behaviors , traits and some expressions, which not everyone agrees , and second because they are spaces that open signal transmitted spread like wildfire in an intolerant society are exaggerated and uneducated like ours.
Programs humor Ecuador would not succeed if they represented situations elsewhere in the world , from different backgrounds and the answer is there to understand why certain reinforce – intentionally or non- discrimination in the country that has always existed spaces. We must stop watching television as the only guilty of segregationists problems because this is part of reflecting our society.
Consider that a possible realization of the complaint by Silueta X before the SUPERCOM not guaranteed , at least for now, the end of discrimination . Achieving this is especially when titanic audiovisual material disseminated on the Internet containing equal or perhaps more discriminatory than many of the parodies and caricatures of some programs that are broadcast by the media.
If we want to end discrimination of vulnerable groups and promote good quality programming in the media is important , more than question the quality of the space, develop respect and tolerance from the family , make the context of current educational reform to propose the inclusion of subjects such as human rights and citizen live from primary , to more structural changes.
