Colectivos GLBTI, complacidos con decisión gubernamental del reconocer uniones de hecho.

Las agrupaciones GLBTI Silueta X y Matrimonio Civil Igualitario se mostraron complacidos con el anuncio que hizo el Presidente de la República, Rafael Correa, el sábado pasado sobre el reconocimiento de las uniones de hecho entre personas del mismo sexo como un estado civil en Ecuador.
El pasado lunes, representantes de los GLBTI mantuvieron un almuerzo con el presidente Rafael Correa, en donde le expusieron el «Informe del acceso a la Justicia y los Derechos Humanos de los TILGB» Durante el 2013. Se explico el caso de Maria Belén Gomez Salgado y Daniela Alcántara Michelena, quienes lograron en Julio del 2012 que la tercera Sala Penal de la corte Provincial de Justicia de Pichincha viabilizara la inscripción en el Registro Civil sobre su unión d hecho, sin embargo, a pesar de ser un precedente legal, en la actualidad no se cumplía.
El Presidente, en conjunto a su gabinete de estado, se comprometió a resguardar las garantías constitucionales. Por tanto, mediante Resolución No. 0174-DIGERCIC-DNAJ-2014 de 2 de agosto, el Director del Registro Civil, Ing. Jorge Troya Fuente, resuelve:
Articulo 1.- Derogar el contenido de la Resolución DIGERCIC-DAJ-2010-0277 de fecha 1 de septiembre de 2010, con la cual es prohibido el ingreso al archivo magnético y consecuentemente a las cédulas de ciudadanía e identidad, a la unión de hecho como estado civil.
Articulo 2.- Registrar las uniones de hecho como un dato complementario del estado civil, de conformidad con la constitución de la República y las leyes aplicables a la materia.
Articulo 3.- Crear el registro especial de uniones de hecho que permita ingresar los hechos de esa naturaleza al Sistema Nacional de Registro Civil, Identificación y Cedulacion.
Articulo 4.- Los registros de uniones de hecho que se efectúen tendrán el carácter de voluntarios y no constituirá requisito para su eficacia o validez.
Articulo 5.- Encárguese de la ejecución y aplicación de la presente resolución, a la Dirección Técnica de Registro Civil, Dirección Técnica de Identificación, Departamento de Tecnología, y Dirección Financiera.
La presente Resolución entrara en vigencia a partir de su suscripción, sin perjuicio de su publicación en el Registro Civil, y el servicio se prestara desde el 15 de septiembre de 2014.
Mientras que el articulo 3 de la resolución ordena: «Crear el registro especial de uniones de hecho que permita ingresar los hechos de esa naturaleza al sistema Nacional del Registro civil, Identificación y Cedulacion».
Esta conquista se califica como «un reconocimiento fraterno a los compromisos adquiridos por el gobierno de la Revolución Ciudadana, pero sobre todo por su ágil ejecución», señala un comunicado de prensa de Silueta X.
Mientras que la agrupación Matrimonio Civil Igualitario, a través de un boletín, expreso que la Resolución del Registro Civil es una avance, «pero no descansaremos hasta alcanzar todas las luchas y tener todos nuestros derechos , uno de ellos, y por el que hemos venido luchando con fuerza desde hace un año, es acceder al Matrimonio Civil Igualitario».
Se expreso ademas que «cuando hay voluntad política, una lucha de dos años puede solventarse en menos de una semana, tiempo que ha tomado que, finalmente, el Registro Civil cumpla, parcialmente, como lo establece una constitución vigente hace casi seis años».
No obstante, se considera que esta es una «Medida paliativa», ya que el articulo 4 de esta Resolución establece el carácter voluntario del registro de las uniones de hecho, «cuando es una obligacion de toda persona dar a conocer al Registro Civil todo cambio de su estado civil, y de la institución de registrarlo».
