Mi unión de hecho en mi cédula es mi derecho

Nos complace comunicarles que el día de hoy Martes 2 de septiembre del 2013 se lanza la campaña: «unión civil igualitaria – Mi unión de hecho en mi cédula, es mi derecho». Esta campaña está siendo lanzada simultáneamente en las ciudades más importantes del país como; Quito, Guayaquil, Cuenca y Machala. Esto nace de la Iniciativa de la Asociación Silueta X de Guayaquil y el Observatorio GLBTI de Ecuador a quienes nosotros como (Asociación Ateísta Ecuatoriana, Comunidad Futura, Fundación Yerbabuena, Articulación Feminista Construyendo Igualdad, Observatorio GLBTI del Ecuador, Tiempo de Igualdad, Silueta X Cuenca, Silueta X Quito, Asociación Alfil, Mano Diversa de Machala, Asociación de Sordos GLBTI, Padres y Madres GLBTI, Colectivo Simpatizantes Heterosexual de los GLBTI, Coalición GLBTI de Ecuador, etc. ), nos hemos unido. Esta campaña cuenta a nivel nacional con quince organizaciones LGBTI y no LGBTI que la conforman. Así mismo contamos con el apoyo de instituciones públicas.

Como antecedente tenemos que desde el año 2008 en Ecuador el artículo 68 de la constitución de la República de Ecuador, reconoce las uniones de hecho entre dos personas, la cual reza:

Art. 68.- La unión estable y monogámica entre dos personas libres de vínculo matrimonial que formen un hogar de hecho, por el lapso y bajo las condiciones y circunstancias que señale la ley, generará los mismos derechos y obligaciones que tienen las familias constituidas mediante matrimonio. La adopción corresponderá sólo a parejas de distinto sexo.

Es decir que desde el año 2008 se reconoce las uniones de Hecho en Ecuador, sin que esta aterrizara debidamente en el ejercicio diario.

A lo largo de estos seis años, tanto las poblaciones heterosexuales como homosexuales nos hemos topado con un sin número de trabas sociales, legales y jurídicas. Hay que recalcar por ejemplo que estas trabas se ven con mayor frecuencia enfocadas hacía la población homosexual, quien históricamente ha sido discriminada.

El 30 de junio de 2010 Daniela y Belén fueron a la Notaria Vigésimo Segunda del cantón Quito a declarar mediante un acta notarial la existencia de su unión de hecho. En el mismo día fueron a las oficinas de la Dirección de Registro Civil, Identificación y Cedulación ubicadas en la Naciones Unidas y Avenida Amazonas, en la ciudad de Quito, para realizar el registro de esta unión de hecho en sus cédulas de ciudadanía. La repuesta que les dio el Departamento Jurídico del Registro Civil fue una negativa de realizar dicho registro.

Esta pareja de mujeres lesbianas, inicia una batalla legal en contra del Registro civil. Luego de esto el 1ero de septiembre del 2010 el Registro civil emite la Resolución DIGERCIC-DAJ-2010-00277, con la cual se prohibió el ingreso al archivo magnético y consecuentemente a las cédulas de ciudadanía de identidad la unión de hecho como estado civil.

El 05 de junio del 2012, la Tercera Sala de Garantías Penales emitió sentencia de aceptación sobre la Acción de Protección presentada por D.A.M. y M.B.G.S. y Dispuso, previo las formalidades de ley, se proceda al inmediato registro de la unión de hecho de las accionantes en el Registro Civil, una vez ejecutoriada la sentencia.

Sin embargo, a pesar de este presente legal, en el año 2012 el registro civil hizo caso omiso. En Octubre del 2013, en una investigación se reveló que de las 42 notarias en la ciudad de Guayaquil, solo 5 realizaban las uniones de hecho a personas del mismo sexo sin ningún problema. Tanto el caso del presente legal, como el de la investigación de la notarias, lo podrán corrobar en el “Informe del Acceso a la Justicia y Los Derechos Humanos de los TILGB” durante el 2013, que se encuentra on line en www.siluetax.com

El 13 de Diciembre del 2013, en la primera reunión con el presidente Rafael Correa Delgado, las organizaciones TILGB expusieron las problemáticas con el Registro Civil, entre estas las uniones de hecho y la Campaña Mi Género en Mi Cédula. El 18 de Agosto del 2014, se entrega en mano del Sr. Presidente Econ. Rafael Correa y su cartera de estado, durante el Almuerzo con los LGBTI el Libro del “Informe del Acceso a la Justicia y los Derechos Humanos de los TILGB que fue concluido en diciembre del 2013”, el cual corroboró las declaraciones de la primera reunión. El Presidente Rafael Correa indicó, que las uniones de hecho son un mandato constitucional y que de suscitarse el caso de no seguir aceptando las uniones de Hecho por parte del registro civil, habría que buscar la posibilidad de buscar a otro director o directora. La Voluntad humana del Presidente Rafael Correa, se vio detonada el viernes 22 de Agosto del 2014 cuando el Registro Civil emitió la Resolución 0174-DIGERCIC-DNAJ-2014 cuyo Artículo numero 3 indica:

Artículo 3.- Crear el registro especial de uniones de hecho que permita el ingreso de los hechos de esa naturaleza al sistema nacional del registro civil de identificación y cedulación. Es así, como el día de hoy en celebración de dicho acontecimiento que revela la lucha de varias situaciones y actores, nació la “Campaña Unión Civil Igualitaria Ecuador – Mi unión de Hecho en mi Cédula es mi Derecho”, cuya finalidad es ser sujetos veedores de todos estos procesos detallados y hacer prevalecer las garantías constitucionales del artículo 68 de la constitución de la República del Ecuador.

Hoy 2 de septiembre ha nacido nuestra campaña, y nuestro punto de efervescencia será el lunes 15 de septiembre del 2014, cuya fecha el registro civil tendrá todos los procesos operativos internos, para poder registrar nuestras uniones de hecho, y así podernos sentir parte de esta ciudadanía ecuatoriana. Este día invitamos a las poblaciones heterosexuales pero con mayor énfasis a las homosexuales, a registrar su unión de hecho en las ciudades principales del país, cuyo hecho emblemático será el impulso de una nueva época del reconocimiento social de las parejas LGBTI en unión de hecho.

Campaign Launch

«Civil Union Equal Ecuador»

My union in my card is my right

We are pleased to announce that today Tuesday September 2, 2013 the campaign launch: «equal civil union – My union in my card, is my right.» This campaign is being launched simultaneously in major cities like; Quito, Guayaquil, Cuenca and Machala. This resulted from the initiative of the Association X Silhouette of Guayaquil and Ecuador GLBTI Observatory to us as (Ecuadorian Association Atheist, Futura Community, Peppermint Foundation Building Feminist Articulation Equality Observatory GLBTI Ecuador, Equal Time, Silhouette X Cuenca Silhouette X Quito, Association Bishop, Hand Diversa Machala Deaf Association LGBTI, LGBTI Parents, Supporters Collective heterosexual GLBTI Coalition GLBTI of Ecuador, etc.), we have joined us. This nationwide campaign is fifteen and no LGBTI LGBTI organizations that comprise it. We also have the support of public institutions.

As background we have since 2008 in Ecuador Article 68 of the Constitution of the Republic of Ecuador recognizes civil unions between two people, which reads:

Art. 68.- stable and monogamous union between two people free from the marriage bond to form a home-made, for the period and under the conditions and circumstances that the law will generate the same rights and obligations established by families marriage.
