El jueves se sabrá si suspenden programa “La pareja feliz”.

Hasta el próximo jueves, los abogados de Teleamazonas y del colectivo GBLTI Silueta X serán notificados por la Superintendencia de Comunicación e Información (Supercom) con la suspensión o no del programa “La Pareja Feliz”.

Durante la audiencia desarrollada ayer, las partes expusieron los alegatos a favor y en contra del segmento. Como antecedente, en este caso existe una resolución del Consejo de Regulación y Desarrollo de la Información y Comunicación (Cordicom), emitida el 5 de agosto pasado, en la que el organismo clasificó como programa “discriminatorio”.

Silueta X, representado por Diane Rodríguez, presentó el 2 de enero de este año la denuncia en contra del citado programa que se transmite en Teleamazonas de lunes a viernes en el horario de las 19:00 (horario familiar), argumentando que se producen al menos cuatro hechos o situaciones que configuran en violaciones a las normas y derechos establecidos en la Ley de Comunicación (LOC).

Se trata, además, de un segmento con “contenido discriminatorio, burlesco no solo de la realidad sociológica de las poblaciones de las diversidades genéricamente diferentes, sino a grupos que la misma Constitución señala como de protección prioritaria”. Como parte de las pruebas, presentó un video de la posible escena discriminatoria y adjuntó un informe del Cordicom que ratifica esta calificación.

Para Alejandro Burbano, abogado del colectivo, la denuncia es en contra del canal y no contra los productores, directores y actores del segmento, por su “irresponsabilidad” al tomar más en cuenta el nivel de sintonía antes de que sea o no discriminatorio, por lo que se basó en lo que estipula el artículo 84 de la LOC y 54 de la Carta Política.

Los abogados de Teleamazonas: Pablo y José Pablo Ortiz, apuntalaron su defensa en el hecho de que el informe del Cordicom se basa en teorías y especulaciones. Dijeron que el contenido no es “discriminatorio” porque se trata de un tipo de comunicación artística.

El programa, aclararon, no es una nota periodística, y en ningún momento ha presentado un hecho discriminatorio de manera explícita ni implícita. Por ello plantearon que se deseche la denuncia, no solo en base a lo que determinan los artículos del 62 al 65 de la LOC, sino el 13 de la Convención Americana de Derechos Humanos que se refiere a atentar contra la libertad de expresión, en caso de haber sanciones para el medio.

Con los alegatos, en los siguientes de tres días laborables habrá una resolución. Según la LOC la diligencia se enmarca en el derecho que tienen el accionante y accionado haga uso de su derecho a la defensa y conteste de forma oral la denuncia. (ANL).

The program, they explained, is not a news story, and at no time presented a discriminatory act explicitly or implicitly. Therefore, they argued that the complaint is disposed of, not only based on what determines Articles 62 to 65 of the LOC, but 13 of the American Convention on Human Rights refers to undermine freedom of expression, if have penalties for the medium.
