La Asociación Silueta X, organización de bases comunitarias sin fines de lucro constituida legalmente el 12 de mayo del 2010 y miembra de la Comunidad Ecuatoriana de Organizaciones Tilgb (CIOTI) , pone en su conocimiento la presente “Queja Legal”, denunciada en nuestras instalaciones. Solicitamos, gentilmente se le de el proceso adecuado ante un posible acto de estigma o discriminación en derechos humanos.

Yo, ANDREA ESTEFANIA SAVERIO TORRES, con cedula # 0705382802, de ciudadanía ecuatoriana, denuncio:

HECHOS

He venido trabajando , desde el 1 de Junio del 2011, hasta el 8 de Febrero del 2013 en la empresa de transporte llamada COTURCIP, la que está ubicada en las calles Sucre 210-1 E/ Pedro Carbo y Pichincha, representada por el señor gerente Dimas Oswaldo Sánchez Noblecilla, en donde labore inicialmente como cajera por tres meses, de ahí asumí el cargo de Administradora por 4 meses, en donde sufrí una serie de abusos, hostigamientos, acosos y discriminaciones por parte del gerente, el mismo que no me ha dado la cara en los meses de Enero y Febrero, viéndolo al sr. Gerente el momento que me agradeció los servicios prestados. Durante mis gestiones en el cargo de administradora me indico que tenía que despedir a un compañero simplemente por ser Gay y después de la salida de mi trabajo al mantener trato con mis antiguos compañeros de trabajo me han sabido comunicar que se han enterado que la causa principal del despido intempestivo al cual fui sometida fue mi orientación sexual “lesbiana”.

En este caso solicito a la Defensoría del Pueblo, se haga presente ante este acto de discriminación pues fui separada de mi trabajo por mi orientación sexual, teniendo en cuenta que estas personas deben de saber que existen leyes y derechos que nos amparan tales como el Art. 11 Inc. 2. Solicito gentilmente al señor Gerente que se me incorpore a mi lugar de trabajo, caso contrario me consiga un nuevo puesto laboral en otra empresa con excelente recomendaciones.

We request you kindly to the proper process for a possible act of stigma or discrimination in human rights.

I, ANDREA TORRES SAVERIO ESTEFANIA with identification card # 0705382802, Ecuadorian citizenship, denounced:

FACTS

I’ve been working since June 1, 2011, until February 8, 2013 at the shipping company called COTURCIP, which is located in Sucre streets 210-1 E / Pedro Carbo and Pichincha, represented by Mr. manager Oswaldo Sanchez Noblecilla Dimas, where labore initially as a cashier for three months, hence I became Administrator for 4 months, where I suffered a range of abuses, harassment, harassment and discrimination by the manager, the same that I have not given face in the months of January and February, seeing mr. Managing the time I appreciated the services rendered. During my efforts in the post of manager indicated that I had to fire an employee simply for being gay, and after the departure of my job to keep dealing with my former colleagues have managed to communicate that I have learned that the main cause of unfair dismissal to which I was subjected was my sexual orientation «lesbian».

In this case ask the Ombudsman, is made present before this act of discrimination because I was separated from my job because of my sexual orientation, keeping in mind that these people should know that there are laws and rights that protect us such as the Art 11. Inc. 2. Kindly request to the Manager that I incorporate into my work place, otherwise I get a new job position in another company with excellent recommendations.
