Unión de hecho será estado civil

La aprobación del proyecto del Código Civil viene con varios cambios. Uno de ellos es la legalización del quinto estado civil: la unión de hecho.

En el país existe la figura de soltero, casado, viudo y divorciado. Si el Ejecutivo lo aprueba, la unión de hecho pasará de ser un dato complementario del estado civil, a uno de ellos.
En el reciente proyecto se establece a la unión de hecho como “la unión estable y monogámica entre dos personas”.
En la normativa actual dice “entre un hombre y una mujer”.
En agosto del 2014, a través de una resolución, el Registro Civil lo estableció como dato complementario, lo que permitió que parejas homosexuales pudieran inscribirse.
Además, para que se reconozca ese estado civil ya no tendrán que transcurrir dos años de convivencia, como se estipula en la actualidad, sino que será en el momento en que la pareja lo decida.
Reacciones. Mauro Andino, presidente de la Comisión de Justicia, aseguró que establecer esa nueva categoría de estado civil garantiza iguales obligaciones y derechos similares a los del matrimonio.
“Si se consolida una sociedad de bienes, en los actuales momentos con la unión de hecho hay problemas, pero hoy, al elevarse como un nuevo estado civil, tiene casi las mismas consecuencias que el matrimonio”, dijo Andino.
Ramiro Aguilar, asambleísta independiente, señaló que Ecuador no tiene la valentía para aprobar el matrimonio igualitario. “Entonces dan diez mil vueltas y se crea la unión de hecho como estado civil. Esto no soluciona el tema real, que las personas del mismo sexo buscan tener una relación igual que las otras”, indicó Aguilar.
La comunidad GLBTI celebra que esto se legalice. Diane Rodríguez, de la organización Silueta X, recordó que fue una de las principales luchas de los colectivos y que se consiguió en base al diálogo con el Gobierno.
