Ministerio de Trabajo discrimina a Transexual

La Asociación Silueta X, organización de bases comunitarias sin fines de lucro constituida legalmente el 12 de mayo del 2010 y miembra de la Comunidad Ecuatoriana de Organizaciones Tilgb (CEOTI), pone en su conocimiento la presente “Queja Legal”, denunciada en nuestras instalaciones. Solicitamos, gentilmente se le de el proceso adecuado ante un posible acto de estigma o discriminación en derechos humanos. A continuación la querella:

Yo, PALMA OSTAIZA PAOLA CELESTE (PALMA OSTAIZA PABLO CESAR), de nacionalidad ECUATORIANA, de estado civil: SOLTERA, ocupación: COCINERA con domicilio en BASTIÓN POPULAR B. 10 MZ. 130 S. 17, de 28 años de edad e identificada con C.I. # 0924520729 ciudadana Transexual, a usted muy respetuosamente de conformidad a las reglas procesales constitucionales,  presentó a usted la siguiente denuncia.

La presente denuncia es en contra de: MARTIN MILOVAN MANOSALVAS LOOR

HECHOS

Desde marzo del 2009, hasta 10 de mayo del 2012, venía prestando mis servicios lícitos y personales en calidad de cocinera, cajera, mesera y parrillera, para el restaurante “Noventazo” representado por los esposos: WENDY VANESSA SALAZAR NARANJO y MILOVAN MARTIN MANOSALVAS, en sus calidades de representante legal y solidario, con una remuneración semanal de $ 70,00 equivalente a $280,00 mensual líquido, no percibiendo nunca bonificaciones de décimos tercero y Cuarto sueldo, aportaciones al IESS, Fondos de Reserva, Vacaciones ni pagadas ni gozadas, utilidades; el horario a cumplir era de dos jornadas desde 08h00 hasta 20h00, o desde las 16h00 hasta las 02h00; de lunes a domingo con 1 día de descanso.

Por haberle solicitado el pago atrasado de mi semana laboral, el10 de mayo de este año, el señor Milovan Martin Manosalvas, dueño solidario del restaurante antes mencionado, de manera grosera manifestó que el pagaba cuando quería si es que le daba la gana, que me retirará que estaba despedida, volviendo a la semana siguiente a solicitarle mis valores pendientes, de dos semanas respondiéndome “que no me va a pagar absolutamente nada, porque no le daba la gana de pagarme y que me retire”.

Luego de esto el martes 14 de agosto de este año, me presente a las instancias de la Inspectoría de trabajo, con el fin de solicitar se investigue lo manifestado en la denuncia que realice, y corroborar el despido intempestivo del que fui víctima por parte de mi empleador, y a solicitar la supervisión del ACTA DE FINIQUITO  de conformidad con la ley. Es así como una vez presentada la denuncia, me acerque el día miércoles 15 de agosto aproximadamente a las 09h00, me dirigí al restaurante del hoy denunciado Martin Manosalvas a entregarle una boleta de citación emitida por el Ministerio de Relaciones Laborales (lo cual me parece que debe cumplirse por parte de esta institución pública pues está poniendo en riesgo mi integridad física y moral debido a la denuncia que le he implantado. Por lo tanto esto podría percibirse como una negligencia institucional).

En el instante que le entregue la citación comenzó a hacerme insultos y ofensas discriminatorias en relación a mi identidad de género anulando y menoscabando mis derechos humanos reconocidos plenamente en la constitución de la República del Ecuador.

Actualmente me encuentro temerosa de mi integridad física pues ese día también me amenazó diciéndome: “que como perro te he de encontrar muerto en la calle”. Esto atenta con mi estado psicológico y moral, pues al momento he desarrollado stres post traumático luego de prácticamente el enfrentamiento, que me colocó el Ministerio de Trabajo, con el Señor MILOVAN MARTIN MANOSALVAS al entregarle la citación, pues me amenazó de muerte.

Conocedora de mis derechos, he continuado con el proceso y luego de una semana me acerque nuevamente al Ministerio de Relaciones Laborales con la Abg. Narcisa de Jesús  Jaime Vera MAT. F.A.G. 02-2008-262, quienes me otorgaron un ticket para ser atendida por un funcionario de esta institución en el módulo #5. Luego de haber expuesto la situación por completo, esta funcionaria se dirigió donde sus superiores (Imaginamos esto) y retornó a los 10 minutos indicando “Que ellos no me podían ayudar porque, yo ya no estaba trabajando allí, no podían hacer una inspección”. Es decir estimada delegada defensora del pueblo, que esta institución ante una evidente violación a los derechos humanos y laborales no puede hacer nada? Es mi pregunta.

Por tanto solicito a la Defensoría del Pueblo, se realicen las gestiones necesarias para poner en evidencia este posible acto de estigma, discriminación y amenaza a mi integridad personal, y de esta forma hacer prevalecer mis derechos humanos y mis derechos laborales. No solo hacia este ciudadano si no a los funcionarios del Ministerio de Relaciones Laborales, si lo hubiere.

Silueta X  Association, community-based organization of nonprofit legally established on 12 May 2010 and a member of the Ecuadorian Community Organizations Tilgb (CEOTI), wishes to inform the present «Legal Complaint», reported in our facilities. We request you kindly to the appropriate process for a possible act of stigma or discrimination in human rights. Then the complaint:

I, PALMA Ostaiza PAOLA CELESTE (PALM Ostaiza PABLO CESAR), an Ecuadorian national, civil status: single, occupation: COOK residing at Bastion Popular B. 10 MZ. 130 S. 17, 28 years of age and identified with C.I. # 0924520729 and Transgender citizen, you most respectfully in accordance with constitutional procedural rules, presented to you the following complaint.

This complaint is against: MARTIN Milovan Manosalvas LOOR

 FACTS

From March 2009 to May 10, 2012, had been providing my personal and lawful services as a cook, cashier, waitress and barbecue, for the restaurant «Noventazo» represented by the spouses: VANESSA WENDY MARTIN SALAZAR Manosalvas NARANJO and Milovan, in their capacity as legal representative and supportive, with a weekly wage of $ 70.00 to $ 280.00 monthly equivalent liquid and will receive no bonuses never third and fourth tenths salary, contributions to the IESS, reserve funds, or paid holidays and enjoyed , utilities, to meet the schedule was two days from 08h00 to 20h00 and from 16h00 to 02h00, Monday to Sunday with one day of rest.

For having applied for late payment of my workweek, el10 May this year, Mr Milovan Manosalvas Martin, owner of the restaurant solidarity aforementioned rudely stated that paid when he wanted if he felt like it, I withdraw was fired, returning a week later to ask my values ​​earrings, two weeks responding to me «I’m not going to pay anything, because he felt like paying me and I retire.»

After that on Tuesday, 14 August this year, I present to instances of the Labour Inspectorate, to request an investigation of the statements made in the complaint, and corroborate the summary dismissal of which I was subjected by my employer, and to seek supervision certificate of settlement in accordance with the law. Thus after filing the complaint, I approached on Wednesday August 15 at approximately 09h00, I went to the restaurant today denounced Martin Manosalvas to deliver a ballot subpoena issued by the Ministry of Labour Relations (which I think be met by this public institution is threatening because my physical and moral integrity because the complaint that I have implemented. therefore this could be perceived as institutional neglect).

The moment that you give me the summons started discriminatory insults and offenses relating to my gender identity nullifying and impairing my rights fully recognized in the constitution of the Republic of Ecuador.

Currently I am afraid my physical because that day also threatened me saying, «Just as I have to find dog dead in the street». This goes with my moral and psychological state, because at the time I developed post traumatic stres practically after the confrontation, I placed the Ministry of Labour, Mr. Milovan MARTIN Manosalvas to deliver the summons, then threatened to kill me.

Aware of my rights, I continued with the process and after a week I may go back to the Ministry of Labor Relations with Abg. Narcisa de Jesus Jaime Vera MAT. F.A.G. 02-2008-262, who gave me a ticket to be served by an officer of the institution in Module # 5. After having explained the whole situation, this officer went where his superiors (imagine that) and returned after 10 minutes indicating «that they could not help me because I was no longer working there, they could not do an inspection.» That is delegated ombudsman estimated that this institution to a clear violation of human rights and labor can not do anything? Is my question.

Therefore I ask the Ombudsman, is take the necessary steps to bring out this potential act of stigma, discrimination and threat to my personal integrity, and thus to assert my rights and my rights. Not only to this city if officials of the Ministry of Labour Relations, if any.
