Matrimonio Gay: Correa da la primera orden a la Asamblea.

El informe para el segundo debate de la reforma al código civil estaba listo.

La reforma al artículo 81 plantea: «Constituir un tipo de familia, auxiliarse mutuamente y asumir los derechos y responsabilidades sujetándose a las disposiciones de la Constitución y este Código»

La última polémica armada por el presidente Rafael Correa con los grupos de gays, lesbianas, transexuales, bisexuales e intersexuales es en realidad su primer vicerazo a la Asamblea donde tiene mayoría plena.

Al asegurar su negativa al matrimonio homosexual, Correa lo que hizo fue meter en la nevera el debate legislativo sobre un asunto que apuntaba a dividir a su bancada: el segundo informe sobre las reformas al Código Civil, heredado de la anterior Asamblea.

Desde su punto de vista, su Gobierno ha rescatado el respeto a las minorías sexuales al poner en su gabinete a gente vinculada a esos grupos, pero hasta ahí. Su postura es no ir más allá, como apoyar el matrimonio gay, al igual que lo hizo en Argentina su coidearia Cristina Fernández; como lo hizo en Uruguay, José Mujica; como lo hizo en Francia el socialista Francoise Hollande, y como lo están haciendo otros presidentes en el mundo.

Pero la polémica entre las minorías sexuales y Correa no es nueva, aunque sí se atizó el último miércoles, luego de que se declarara, en una entrevista en televisión, «muy progresista en la parte económica y social, pero bastante conservador en cuestiones morales».

En julio de 2012, un comentario ofensivo en su contra fue publicado en el portal de El Comercio, sobre su presunto interés en participar en el desfile de la delegación de Ecuador de los Juegos Olímpicos de Londres.

Su reacción no se hizo esperar y en una sabatina, después de criticar al periódico, que se disculpó por no haber filtrado el agravio, Correa se lanzó contra el autor del infundio. «Si son tan machitos vengan. Me avisan si ustedes lo conocen, me avisan donde encontrarlo; me despojo de todas las prerrogativas de Presidente y que me venga a decir de frente, pues todo esto para ver quién es el badea. Solito voy a invitarlo para que me diga estas bascosidades, pero de frente para ver quién es el marica».

El comentario causó indignación en los colectivos GLBT que le respondieron en una carta. «Como ciudadan@s GLBT de este país, nos ha dolido que un individuo procaz y descalificado, en El Comercio edición on-line, haya descargado todo su odio homofóbico y enfermizo tratando de ofender a Correa, pero mucho más ha dolido que, al responder, Correa haya hecho gala de su semi-oculta homofobia, cosificandonos al llamarnos badeas y despectivamente maricas».

A la semana siguiente, el presidente pidió disculpas públicas a la comunidad homosexual que vio tintes homofóbicos en su declaración. «Tal vez perdí la cabeza, tal vez me extralimité y dije que venga este señor para decirme personalmente si soy badea, marica. Básicamente era en el sentido de para ver quién es el cobarde -dijo-. No excluyo que uno nació en una sociedad llena de prejuicios, estigmas y que queden esos rasgos, hay que combatir esas cosas. Señores miembros de la comunidad GLBT, si cometí un error, les pido sinceramente las más sinceras disculpas (…) y les reitero el compromiso de este Presidente, este Gobierno, de luchar contra la discriminación en todas sus formas y, peor aún, si son discriminaciones por preferencias sexuales». Eran los tiempos del ambiente preelectoral, seis meses antes de las elecciones presidenciales de 2013.

En esos meses también avanzó en la Asamblea, paralelamente, el tratamiento del proyecto de reforma del Código Civil que planteaba una serie de cambios, entre ellos la reforma el artículo 81, que define el matrimonio como una institución cuya finalidad es vivir juntos, procrear y auxiliarse mutuamente. La propuesta fue sustituirlo por uno que diga: «Constituir un tipo de familia, auxiliarse mutuamente y asumir los derechos y responsabilidades sujetándose a las disposiciones de la Constitución y este Código».

El proyecto inicial fue presentado por María Paula Romo, Marisol Peñafiel, Paola Pabón, Silvia Salgado y Virgilio Hernández, quien en febrero pasado salió a argumentar en la agencia gubernamental Andes la necesidad de cambiar esa norma legal. Hernández tachó de obsoleto el Código vigente en relación a los conceptos de familia, mujer, hombre y niño, unión libre y divorcio. La unión entre la mujer y el hombre es un tipo de familia y la Constitución de la República reconoce otros tipos de familias, argumentó en esa ocasión.

En ese debate no intervinó el presidente de la República hasta su enlace sabatino del 18 de mayo, una semana antes de su posesión.

Lo hizo tras rechazar la convocatoria hecha para el día siguiente por un grupo social, denominado 14 Millones, contra las políticas de planificación familiar que lleva adelante el Gobierno.

Correa primero rechazó que ese grupo haya afirmado que las clases de educación sexual impartidas en los colegios promuevan la promiscuidad y las relaciones sexuales sin responsabilidad y a su vez negó que el Gobierno aliente el matrimonio entre homosexuales y el divorcio express o fácil, algo que está en las reformas del Código Civil.

«Es lamentable la percepción de la realidad que tiene el mandatario y su postura por demás ambigua, que incluso cuestionó al movimiento 14 Millones, por sus falacias conservadoras, para segundos después, hacer gala de una postura igualmente retrógada y anacrónica, pues desconoce que en el país, pese a su postura anti derechos, ya existen familias diversas, que sin embargo, viven en condiciones de discriminación, gracias a la visión excluyente del Estado, como la manifestada por el mandatario».

Esta vez no hubo disculpas, sino una ratificación de su postura en un tema que pasa ahora a las manos de la Asamblea con una amplia mayoría del oficialismo, donde gran parte de sus coidearios están a favor del reconocimiento de otro tipo de familia. El Presidente lo que hizo fue trazar la cancha en el debate en el Código.

En el proyecto, la propuesta de los colectivos GLTBI es que en las cédulas de identidad se cambie el rótulo de sexo (masculino o femenino) por el de género, con lo que una persona podría registrarse según su orientación sexual. «La palabra sexo en la cédula más género; pero reemplazar sexo por género no lo voy a aceptar nunca», dijo Correa al desestimar un debate legislativo sobre esa cuestión porque había más urgencias como para desgastarse en esas discusiones. «Como ciudadana Transexual y parte de las poblaciones LGBT, me ha menoscabado y herido que un colectivo de extrema derecha, autodenominado con el dato estadístico, que representa a las personas que vivimos en Ecuador, difunda calificativos que atentan contra la integridad de personas de la diversidad sexual y de quienes promueven progresos en temáticas reproductivas.

Pero sin duda lo que mucho más me afecta y por supuesto que nos hiere a las poblaciones LGBT, es que para muchos ecuatorianos de la diversidad sexual, nuestro Mandatario el Econ. Rafael Correa, nos considere ciudadanos que aún se nos cuestiona por nuestras luchas, luchas básicas como acceder a derechos, que para unos está dado, por el simple hecho de calzar en estas normas hegemónicas binarias, y que para otros, se nos niega por ir en contra de su rigidez.

¿Acaso los derechos están dados únicamente, para los que obedecen los estereotipos sociales?

Estamos en una Revolución Ciudadana, que se ha convertido afortunadamente en una Revolución para las especifidades como: las personas con capacidades especiales, las personas indígenas, las personas de escasos recursos, las mujeres, los jóvenes, los derechos reproductivos, etc. Sin embargo, aún estamos esperando que los Derechos Sexuales entren en esa Revolución, en ese ejercicio que ha contagiado a todo aquel, que alguna vez fue excluido y que eso ha hecho posiblemente enriquecedor este proceso en Ecuador.

Las personas que hacemos Revolución Sexual, estamos aún aquí sentados «como niños», esperando que se nos dé la oportunidad de concretar, un proceso que indiscutiblemente es histórico en nuestro País, y que a pesar, que nuestras promociones son desde la sociedad civil organizada, necesitamos del apoyo de quienes hemos depositado nuestra representación. Porque hay que reconocer algo, que desde la sociedad civil podemos atrincherarnos desde nuestras bases de lucha, pero estas se concretan en ejercicio cuando los líderes que nos gobiernan, se apropian de nuestras convicciones; convicciones, que no son más que los ejemplos de las luchas, que tuvieron los afrodescendientes, por la abolición de la esclavitud y la mujer por su liberación doméstica y también sexual».
