Carta a Rafael Correa sobre Reformas a la Ley del Registro civil por parte de Diane Rodríguez

En su despacho.-
Como ciudadana Transexual y parte de las poblaciones LGBT, me ha menoscabado y herido que un colectivo de extrema derecha, autodenominado con el dato estadístico, que representa a las personas que vivimos en Ecuador, difunda calificativos que atentan contra la integridad de personas de la diversidad sexual y de quienes promueven progresos en temáticas reproductivas.
Pero sin duda lo que mucho más me afecta y por supuesto que nos hiere a las poblaciones LGBT, es que para muchos ecuatorianos de la diversidad sexual, nuestro Mandatario el Econ. Rafael Correa, nos considere ciudadanos que aún se nos cuestiona por nuestras luchas, luchas básicas como acceder a derechos, que para unos está dado, por el simple hecho de calzar en estas normas hegemónicas binarias, y que para otros, se nos niega por ir en contra de su rigidez.
¿Acaso los derechos están dados únicamente, para los que obedecen los estereotipos sociales?
Estamos en una Revolución Ciudadana, que se ha convertido afortunadamente en una Revolución para las especifidades como: las personas con capacidades especiales, las personas indígenas, las personas de escasos recursos, las mujeres, los jóvenes, los derechos reproductivos, etc. Sin embargo, aún estamos esperando que los Derechos Sexuales entren en esa Revolución, en ese ejercicio que ha contagiado a todo aquel, que alguna vez fue excluido y que eso ha hecho posiblemente enriquecedor este proceso en Ecuador.
Las personas que hacemos Revolución Sexual, estamos aún aquí sentados “como niños”, esperando que se nos dé la oportunidad de concretar, un proceso que indiscutiblemente es histórico en nuestro País, y que a pesar, que nuestras promociones son desde la sociedad civil organizada, necesitamos del apoyo de quienes hemos depositado nuestra representación. Porque hay que reconocer algo, que desde la sociedad civil podemos atrincherarnos desde nuestras bases de lucha, pero estas se concretan en ejercicio cuando los líderes que nos gobiernan, se apropian de nuestras convicciones; convicciones, que no son más que los ejemplos de las luchas, que tuvieron los afrodescendientes, por la abolición de la esclavitud y la mujer por su liberación doméstica y también sexual.
Hoy, el escenario de lucha continua, y los actores sociales somos otros, que justamente para muchos representamos “El quiebre de un estereotipo”, un estereotipo que asegura que sus procesos tradicionales y conservadores, se sigan legitimando aún más con el tiempo y teniendo en cuenta, que lo legitimado tiene más peso social, que lo legal en ejercicio.
Estereotipos contra los que lucharon los mismos afros y mujeres, y que a pesar que sus luchas continúan, por lo menos hoy, pueden transitar en estos espacios hegemónicos, otorgados para unos y restados para los diferentes. Quienes se oponen hoy, a la promulgación de nuestros derechos, son los mismos que se opusieron en aquellas memorables luchas, en las que muchos activistas sacrificaron sus vidas, desde el vaciamiento de su sangre, hasta la muerte; y que sus iguales hoy transitan por este mundo, sin revisar porque hoy sus derechos están dados y gracias a que o a quién.
Para los que vivimos enamorados de nuestras luchas, nos resulta enorgullecedor que nuestro Mandatario pida disculpas, por un desliz motivado por un estereotipo cultural. Pero en contraste, nos ha resultado hiriente que nuestras luchas se pretendan parar, posiblemente por malos entendidos.
Una ley del Registro civil reconoce eso: Identidad y no tiene que ver con el matrimonio ni la adopción. Para que se concretara el Matrimonio igualitario y la adopción habría que hacer reformas a la Constitución de la República del Ecuador y al Código Civil. Esa lucha no es ahora, ni es determinante para la “Identidad de género”, que se la reconoce en el Art. 11 Num. 2 y con la cual he podido y hemos podido, evadir medianamente la discriminación. Sin embargo, ese proceso está a medias y con las Reformas a la Ley del Registro Civil en materia de Identidad de Género, eso es lo que buscamos, completar un proceso, que incluso afecta a la población en general, pues la Identidad de Género no es patrimonio de los LGBT o grupos Trans, sino de todo aquel que se considere ser humano. El hecho que se nos divida en sexos, cuando esto es algo íntimo, tan íntimo, que cuando nos cedulamos nos toman fotos de nuestros rostros y no de otras partes corporales. Deseamos que la intimidad sexual sea conservada y lo público que es el género, que es legítimo, sea ahora legal.
Las temáticas de adopción y matrimonio igualitario, estarán dadas para otro tiempo y espacio, que no es el de la presente, y que grupos conservadores de ultra derecha, en su afán por seguir legitimando sus posturas medievales, han envuelto el tema como uno solo.
Estimado presidente, he tomado la palabra de muchas personas LGBT´s y otros que no lo son, que vieron el Enlace Ciudadano este sábado 18 de Mayo, para solicitarle que reconsidere el análisis, sobre el pronunciamiento ante las reformas a la ley del registro civil en Materia de Identidad de género.
Considero y consideramos que las temáticas de diversidad sexual están siendo mal asesoradas, y que un agotamiento de los argumentos es válido, en un estado democrático, hasta el punto de llegar a una conciliación. Por tanto y por medio de la presente, solicito y solicitamos audiencia, en el lugar, día y hora que usted disponga.
Para quienes se nos ha quitado todo, estimamos que la simple visibilización de nuestra identidad es un acto de derecho, un acto que posiblemente puede afectarse con el daño a nuestra integridad, comprometiendo incluso nuestras vidas; vidas, que queremos asegurar a través de leyes para quienes son nuestros iguales y que no son activistas, y que en efecto poco o mucho nos importa a quienes hacemos Revolución Sexual nuestro final, similar o peor, a quienes han hecho historia en las luchas raciales y de la mujer.

As Transexual citizen and part of LGBT populations, undermined and hurt me a right-wing group, calling itself the statistic, which represents the people who live in Ecuador, disseminate descriptions that undermine the integrity of people of diversity who promote sexual and reproductive issues progress.
But undoubtedly affect me that much more and of course hurts us LGBT populations, is that for many Ecuadorians sexual diversity, our president Econ. Rafael Correa, consider us citizens that still challenges us by our struggles, basic struggles as access rights, which for some is given, by the simple fact fit into binary hegemonic prescriptions, and for others, we refuse to go against its rigidity.
Are the rights are given only to those who obey social stereotypes?
We are in a Citizen Revolution, which fortunately has become a revolution to the specifics as people with special needs, indigenous people, poor people, women, youth, reproductive rights, etc.. However, we are still waiting for the Sexual Revolution enter that in that year that has infected every one, was once excluded and that has made this process possibly enriching Ecuador.
People who do Sexual Revolution, we are still sitting here «like children» hoping that we be given the opportunity to realize a historical process that is unquestionably in our country, and that despite that our promotions are organized by civil society , we need the support of those who have placed our behalf. Because we have to recognize something that the civil society can retrench from our bases of struggle, but these are realized in practice when the leaders who govern us, appropriated our convictions, convictions that are merely examples of the struggles , who had of African descent, for the abolition of slavery and women for their domestic and sexual liberation.
Today, the scene of continuous fighting, and social actors are others that just to many represent «The breakdown of a stereotype», a stereotype that says that their traditional and conservative, further legitimizing continue over time, taking into account, which has more weight legitimized social, legal you exercise.
Stereotypes against those who fought them afros and women, and despite his struggles continue, at least today, can move in these spaces hegemonic granted to some and subtracted for different. Opponents today, to the enactment of our rights, are the same who opposed those memorable struggles, which many activists sacrificed their lives, from the emptying of his blood, even death, and that his peers today transiting this world, because today unrevised rights are given and by what or whom.
For those who live in love with our struggles, we find that our president enorgullecedor apologize for a slip motivated by a cultural stereotype. But in contrast, we have found hurtful that our struggles are intended to stop, possibly misunderstandings.
A civil registry law recognizes that: Identity and has nothing to do with marriage or adoption. In order to materialize the equal marriage and adoption reforms should be made to the Constitution of the Republic of Ecuador and the Civil Code. That fight is not now, nor is decisive for the «gender identity», which is recognized in Article 11 No. 2 and with which I could and we could, moderately evade discrimination. However, that process is half and the Amendments to the Civil Registry Law on Gender Identity, that is what we seek, completing a process that even affects the general population, because no gender identity ‘s assets or groups of LGBT Trans, but anyone who considers themselves to be human. We want sexual intimacy is preserved and the public that is gender, which is legitimate, is now legal.
The themes of adoption and marriage equality, will be given to another time and space, which is not the present, and right-wing conservative groups, eager to follow medieval legitimizing their positions have involved the issue as one.
Dear President, I have the word of many people LGBT’sy others who are not, who saw his radio on Saturday May 18 to ask you to reconsider the analysis, on the pronouncement before the reforms to the civil registration law Gender Identity Matters.
I think and believe that the issues of sexual diversity are being ill-advised, and a depletion of the arguments is valid, in a democratic state, to the point of reaching a settlement. And therefore by hereby request and request hearing at the place, day and time you have.
For those who have taken everything from us, we believe that the mere visibility of our identity is an act of law, an act that can possibly be affected by the damage to our integrity, jeopardizing even our lives, lives that we want to ensure through legislation to who are our equals and who are not activists, and in fact little or much we care who our end we Sexual Revolution, similar or worse, who have made history in the racial struggles of women.
